OD and Legal/Ethical Issues in Performance Management

How do you evaluate your organization's performance management practices and guide change?  Can you design an effective performance management program that ensures the legal and ethical considerations are systematically addressed?   Performance management processes are often scrutinized in cases of discrimination or dismissal. Tomorrow's successful organizations will require performance management process that are informed by modern theory and practice without putting the organization at increased risk for litigation.  

In this interactive program, we will discuss the legal and ethical issues involved with performance management and how OD practitioners can guide informed change as old practices fall away and new trends in performance management emerge. Organizations are moving away from the Annual Review and forced ranking systems, toward more frequent feedback focused on goals and development. We’ll hear about what leading edge solutions look like at Performance Consulting firm Engagedly, and give participants a chance to “Ask the Attorney” as they’re evaluating new tools and processes for Performance Management.

Jessica Liss, Jackson Lewis, PC

Jessica L. Liss is the Office Managing Principal of the St. Louis, Missouri office of Jackson Lewis, P.C. She oversees all litigation matters handled by the St. Louis attorneys. Ms. Liss has been based in St. Louis her entire career and has extensive experience litigating all forms of employment and civil rights matters.

As a trial lawyer, Ms. Liss has been representing employers at the trial and appellate level in state and federal courts. Ms. Liss also provides on-going legal support and counsel on a daily basis for many of her clients. She routinely provides training to managers, supervisors and staff in all areas of employment law, including, but not limited to, supervisor training, sexual and racial harassment prevention, sexual stereotyping and gender issues in the workplace, disciplinary practice, documentation policies, safety and disability management. 

Ms. Liss is listed as a Super Lawyers in the areas of employment defense and first amendment rights. She has been named a Rising Star by Missouri Lawyers Weekly. She is also a frequent speaker on employment matters and litigation avoidance.
